Terms and Conditions of Sale



Prices are firm except in the case of certain new machines not currently in our stock where manufacturers charge prices ruling at time of despatch and/ or are subject to currency exchange rate fluctuations (if any).


All carriage charges will be charged extra.  Our responsibility ceases upon delivery to carriers ex-our works or when our own transport is employed, on delivery to the purchaser’s premises.  No liability attaches to us in respect of loss, damage or delay in transit however occasioned except when goods are delivered by our own vehicles.


The delivery dates given are submitted without liability for delay however occasioned, but every effort will be made to maintain them.


(a) In the event of goods not being received within seven days of the date of despatch, immediate notice must be given to us.  (b) Unless goods delivered by our own vehicles all carrier’s waybills should be endorsed “Condition Unexamined”.  (c) Any damage, breakage or shortage must be notified to the carriers and to ourselves within three days of receipt of goods.


Unless otherwise stated NEW machines are guaranteed in accordance with the terms of warranty issued by the manufacturers of the equipment in question.  USED machines in CATEGORY (A) REBUILT are guaranteed for a period of twelve months from the date of despatch, ie we undertake to correct free of charge any parts found to be defective as a result of faulty workmanship or negligence in our own works but do not accept responsibility for faults, breakdowns, etc, which may occur due to insufficient or incorrect maintenance, usage of the machine beyond the capacity/performance for which it was designed or running adjustments.  Neither can we be responsible for work carried out by the purchaser or any contractor other than that authorised by ourselves.  Machines supplied in CATEGORY (B) PREMIUM SERVICE are covered by six months warranty against electrical or mechanical breakdown only.  In all categories we disclaim all liability for consequential damage or loss of production and parts alleged faulty must be returned carriage paid for inspection at our works.  It should be noted that correct installation on satisfactory foundations and electrical connection to adequate power supply are the purchaser’s responsibility and failure to implement any of these procedures will automatically invalidate the warranty.  Guarantee periods calculated from date of invoice.  Machines supplied in CATEGORY (C) STANDARD SERVICE do not incorporate a warranty but as with other used machine categories described above are supplied on free approval in UK … see note below.

NOTE 1 – Warranty covers parts and labour providing the equipment has been commissioned at the point of installation by ourselves … in cases where commissioning is not implemented the warranty will cover parts only in line with the warranty provided by the manufacturers of the machines.

NOTE 2 – All warranty conditions as outlined above are subject to dust extraction at point of cut being provided which is adequate in our opinion for the process and materials involved.


Goods supplied by us shall be at the buyer’s risk immediately on delivery to the buyer or into custody on the buyer’s behalf (whichever is the sooner) and the buyer should therefore be insured accordingly.


Property in goods supplied by us will only pass to the buyer when the goods which are the subject of the contract have been paid for in full.  When payment has become due and has not been received in full by us we shall have the right at our absolute discretion to treat the contract as discharged and to repossess the goods supplied thereunder.  In the event of the buyer becoming insolvent or a Liquidator or Receiver being appointed to administer the buyer’s affairs prior to payment in full to us we shall have the right at our absolute and sole discretion to forthwith treat the contract as discharged and to repossess the goods.


No liability can be accepted for any damage or loss either consequential or direct, whether to the purchaser or third parties, that may arise after goods have left our premises.


Customer’s order forms containing special printed conditions will be understood to be binding only where they are not at variance with our conditions and terms.


Cancellation will only be accepted on terms which will specifically provide against any financial loss to the seller.  Accordingly, we reserve the right at our discretion to retain deposits paid as compensation for any costs or inconvenience incurred.


Previously owned machines, whichever of the above categories apply, are supplied on free approval (in UK), ie may be returned within 30 days of date of despatch should any non-conformance be found with the appropriate condition category as defined above. If however such a machine has been specially obtained at customer request specifically to suit individual requirements this arrangement would not apply. Inability of a machine to perform tasks other than those for which it was specifically designed do not constitute grounds for return and modifications or changes to specification implemented at purchaser’s request either before or after delivery also invalidate this option.
